Enfranchisement
Expert help and advice for landlords and leaseholders
The enfranchisement process, whether through the statutory or voluntary route, is complex. Our team of solicitors have extensive experience in all voluntary and statutory enfranchisement matters (both under the Leasehold Reform, Housing and Urban Development Act 1993 and the Leasehold Reform Act 1967).
JB Leitch Real Estate Limited acts for both landlords and leaseholders on collective enfranchisement matters, providing expert advice tailored to each individual case whether the enfranchisement is voluntary or statutory. The majority of our work involving leasehold enfranchisement is completed on a fixed fee basis.
We carry out all parts of the enfranchisement process including:
- Initial title check and qualifying criteria review
- Liaising with our client’s nominated valuer
- Drafting and serving the notice/counter notice
- Dealing with FTT proceedings
- Drafting/reviewing the new lease
- Ensuring registration of the new lease at HM Land Registry
In light of the ongoing programme of leasehold reform and recent media spotlight on leasehold houses, a large proportion of our practice now focuses on individual sales of freeholds.
We are able to confidently advise our clients throughout the enfranchisement process, draft all necessary documentation and ensure that the registration process is completed to a timescale that meets our clients’ needs.
