Revised Section 8 and Section 13 Notice forms

Robert Denman Head of Real Estate at JB Leitch explains the implications of revised Section 8 and Section 13 Notice forms:

On 6th April 2015 the Assured Tenancies and Agricultural Occupancies (Forms) (England) Regulations 2015 come into effect.

Letting Agents should be aware that the Regulations revoke and replace both The Assured Tenancies and Agricultural Occupancies (Forms) Regulations 1997 and the Assured Tenancies and Agricultural Occupancies (Forms) Regulations 2003.

These new Regulations, amongst other items:

  1. Amend the prescribed format of the section 8 Notice so that it now includes references to mandatory ground 7A (which relates to anti-social behavior) and discretionary ground 14ZA (which relates to an offence taking place at a riot).
  2. Amend the prescribed format of the section 13 Notice which proposes a rent increase during a periodic tenancy.

The new prescribed form of each of the notices appears in the schedule of the Regulations.

Letting Agents and Managing Agents managing properties in England for residential landlord clients should be aware of these changes and if they have not done so already they should update the wording of their Section 8 and Section 13 Notices before 6th April. Failure to do so may mean that incorrect Section 8 and Section 13 Notices served on tenants after 6th April 2015 may be deemed by a court to be invalid.
